The Festival Box Office portal service (“Service”) includes the web portal hosted at www.festivalboxoffice.org and may be used only in compliance with the Terms of Use stipulated in this document. By using the Service, you as the user are deemed to have accepted the Terms of Use in the currently applicable version.
Industrial Property Rights
The Festival Box Office web portal service is operated by Art & Popcorn Motion Picture Company and FBO Film-Datenerfassung GmbH (“FBO”).
All data is collected by FBO in accordance with the stipulations of the film licensors. The screening information is time delayed to varying extents.
Calling up, saving, copying, or printing the websites, their contents, or any results generated or displayed with the presentation tools, in full or in part, is permissible only for non-commercial use. Calling up and displaying the Service is permissible only with the tools provided by FBO, that is by presentation in a web browser. Any call-up or extraction of the raw data or any automatic call-up of the Services is expressly forbidden.
Any duplication, transmission, distribution, data transfer, reproduction, publication, or sale of contents is expressly forbidden, unless with the prior, explicit consent of FBO in writing. All actions extending above and beyond the stated uses shall require the prior, written consent of FBO. References to copyright and trademark designations may not be modified or removed.
Liability Disclaimer
Despite taking care with regard to procurement and provision, FBO and the deployed data suppliers shall not accept any liability for the correctness, completeness, or accuracy of the festival data, companies data, film data, screenings data, and other contents (“data contents”) provided for call-up and displayed in the Service. The data contents are provided “as is” and FBO and its licensors do not accept any warranty for the Service.
The data contents that are provided for call-up and displayed and the results generated and displayed with the supplied presentation tools are intended exclusively to inform any visitors to the Service and do not represent advice or any other form of recommendation.
FBO is responsible exclusively for those data contents that FBO itself has created, published, and distributed. Insofar as downloadable data contents are inserted and made accessible by third parties or by their commission, FBO shall not accept liability of any kind for the contents, the correctness, the actuality, or reliability of the items, nor for any possible typing or transmission errors. Claims of any kind whatsoever arising from items from third parties should therefore always be submitted by the user directly to the relevant third party and not to FBO.
FBO is not liable for any damage, losses, or consequential damage that may arise from the use of these Service. This includes any loss in earnings (regardless of whether direct or indirect), reductions in goodwill or damage to corporate reputation, or any incurred data losses.
Transfer of Rights, Granting of Rights
Any import of items (text, photos, etc.) by the user shall be deemed to be a warranty that the user possesses and/or has been granted fully and effectively all the necessary rights and so possesses the right to import the items without restriction and without fee into the Services for use, for imitation, for modification, for processing, for publication, for translation, for worldwide public provision, and for connection to other items. Any import by the user must be carried out in compliance with all relevant statutory provisions (e.g. copyright law). The user must pay all incurred fees and duties (collecting societies).
Upon import, the user grants himself or on behalf of the legal owner to FBO the non-exclusive right to distribute these items, to modify them, to process them, to translate them, to publish them, to integrate them in other items of any form, and to use them for advertising purposes without any restriction with regard to time, location, or content. FBO hereby reserves the right to delete any illegal items or to block access to such items.
Data Protection
Any personal data that is transferred to FBO during the setup of the Service shall be collected, stored, and electronically processed by FBO with extreme care, discretion, and in compliance with the relevant laws. The provisions of the data-protection laws in the version currently applicable in the country of the user shall be observed.
The user hereby agrees that his specified master data may be stored by FBO and processed for the purposes of its internal market research and advertising. The user hereby explicitly consents to be informed about campaigns by e-mail, text message, multimedia message, etc., even in the form of mass mailings, and also for the purposes of advertising. This consent may be revoked by the user at any time.
The user is obliged to keep his user name and password, and all data that would permit unauthorized access through his user access, secret and to protect them from unauthorized access by third parties. FBO shall not accept any responsibility for unauthorized or improper use. The user is obliged to report immediately any unauthorized or improper use of his user access. FBO is entitled to maintain logs of IP addresses.
Cookies
FBO uses software from third-party suppliers for analyzing the use of our Services ("Google Analytics"). This makes it possible to evaluate the use of the Services and to gain valuable information about the needs of our users. These findings contribute to improving the quality of our portfolio even more and to adapting the Service better to the requirements of the users. We also use cookies, which are text files that are stored on the computer of each visitor to the Service. Cookies make it possible to recognize each user when they return to the Service. This allows us to carry out the evaluation of the Service use, as described above. In general, cookies may be refused or deleted through corresponding browser settings. However, in this case it is possible that some functions of our Service will no longer be available in full.
Other Terms of Use
The provided information may only be called up in such a way that does not impair the use of the Service by the other visitors and which corresponds to the use intended by FBO.
FBO may carry out new developments and modifications to the Service at any time and without notice, which may modify, restrict, or entirely delete the existing functions. FBO is also entitled to restrict or to deactivate the access of users and to suspend the Service at any time. FBO reserves the right to modify or to delete information or data at any time without any specification of reasons.
It is not permissible to embed or to present the websites belonging to this online service or their contents in a pane (e.g. frame or Iframe) using a hyperlink. External links to entire pages in each case (including navigation frame) are permitted.
These contractual conditions do not impair the statutory rights granted to the user at all times as a consumer in the respective country of the user and that cannot be altered or modified on a contractual basis.
All legal relations of the parties shall be subject to Austrian law, under the exclusion of the UN Convention of Contracts for the international sale of goods and the rules of conflicts of laws of international private law. Vienna is hereby agreed as the place of performance and the exclusive court of jurisdiction, insofar as there is no compulsory court of jurisdiction.
Insofar as any individual provisions of these General Terms and Conditions contradict mandatory, statutory regulations or are invalid, the remaining provisions shall remain valid. Such provisions shall be replaced by valid and enforceable provisions that achieve the intended purpose as closely as possible. This shall also apply in the event of any loopholes.
